There are 3 types of tenancy agreements. 📑
📌A lease agreement for a specific period of time(Umowa najmu mieszkania na czas oznaczony)📌
A fixed-term contract is signed with an exact end date. Neither party may terminate such a contract before this date, except in cases specified in separate clauses of the agreement.
These clauses provide that the landlord may terminate the contract if the tenant uses the object of the contract for purposes other than its intended purpose or causes substantial damage to it, and the tenant may terminate the contract if the object of the contract does not comply with sanitary standards.
📌Laase agreement for an indefinite period of time (Umowa najmu mieszkania na czas nieoznaczony)📌
An indefinite-term contract is concluded without specifying a specific end date of the contract.
By default, either party may terminate such a contract by giving one month’s written notice to the other party before the intended date of termination. The contract may, however, provide for another period of early termination (in Polish – termin wypowiedzenia umowy najmu).
📌Umowa najmu okazjonalnego📌
The contract must be in writing in order to be valid. The contract najmu okazjonalnego must be accompanied by:
🖇 a notarized statement from the tenant in which the tenant has undertaken to vacate and surrender the property;
🖇the tenant’s indication of another room where he will be able to live if he fulfills his obligation to vacate the premises (Lokal zastępczy). Lokal zastępczy must be located in Poland;
🖇 the owner’s declaration of consent for the tenant to live in the premises specified in the declaration.
